General Terms and Conditions of Use of the La Poste Ventures Website

ARTICLE 1 – DEFINITIONS
In these General Terms of Use, words or expressions beginning with a capital letter shall have the following meaning:
“General Terms of Use” or “GTU”: refers to the present terms of use of the laposteventures.fr website, of which the personal data protection policy accessible on the Site via the “Personal Data Protection” tab is an integral part.
“Site”: refers to the LA POSTE VENTURES website accessible from the URL www.laposteventures.fr or laposteventures.fr or any other URL that may be substituted for it.
“User”: refers to any natural or legal person who visits one or more pages of the Site.
ARTICLE 2 – PURPOSE
The present Terms and Conditions of Use govern access to and use of the Site and are intended to define the terms and conditions of use, regardless of the mode of consultation (computer, tablet, smartphone or any other terminal or device).
ARTICLE 3 – ACCEPTANCE AND MODIFICATION OF THE GGU AND THE SITE
3.1 Access to and use of the Site are subject to acceptance of and compliance with these General Conditions of Use.
By browsing the Site, regardless of the technical means of access and the terminals used, you are presumed to be aware of these GCU and to accept their terms without reservation.
These GTU apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.
The User may consult them at any time, download them, print them and keep a copy.
3.2 The GTC may be modified at any time by LA POSTE VENTURES due to the evolving nature of the Website, in particular by making new features available, or by removing or modifying certain features. The User is therefore advised to refer to the latest version of the GTCs before any browsing, which can be accessed at any time on the Website. In the event of disagreement with the GTU, the User may not use the Site.
ARTICLE 4 – ACCESS TO THE SITE AND USE OF SERVICES
4.1 The Site is accessible free of charge to any User with Internet access. All costs related to access to the Site, whether hardware, software or internet access costs, are the sole responsibility of the User.
4.2 The User who wishes to be contacted by LA POSTE VENTURES teams must fill in the form in the “Send your pitch” tab. The User undertakes to provide accurate, complete and up-to-date information. Failing this, the User will not be contacted again and LA POSTE VENTURES reserves the right to take any measure it deems useful to suspend access to the Website, permanently or temporarily.
ARTICLE 5 – INTELLECTUAL PROPERTY
The Website constitutes a work protected by the laws in force on intellectual property of which LA POSTE VENTURES is the author.
The general structure, texts, images, whether animated or not, and all the elements making up the Website are protected and are subject to French and international legislation on copyright and intellectual property. All reproduction rights are reserved, including for downloadable documents and iconographic and photographic representations.
LA POSTE VENTURES is a registered trademark. Any use of this trademark without prior written authorisation from its owner is prohibited.
Any use whatsoever of the brand names and logos present on the Website, including but not limited to the brand names and commercial names held by LA POSTE VENTURES and/or LA POSTE and/or XANGE, is prohibited without the authorisation of the rights holders. Any reproduction, representation by any means whatsoever, in whole or in part, of the Website or of one of its elements, without the express and prior authorisation of LA POSTE VENTURES and/or LA POSTE and/or XANGE or their partners, is strictly forbidden and would constitute an infringement of copyright.
ARTICLE 6 – HYPERTEXT LINKS
6.1 The Website may contain hypertext links to other websites over which LA POSTE VENTURES has no control. Despite the checks carried out prior to setting up any hypertext link on its website, LA POSTE VENTURES declines all responsibility for the content of these sites and any updates that may be made to them.
6.2 LA POSTE VENTURES authorises the creation of hypertext links to any page or document on its site, provided that these links are not set up for commercial or advertising purposes. Such links may only be set up on condition that the authors of the link have previously informed the Site’s webmaster. Naturally, this authorisation does not apply to sites that disseminate information of an illicit, violent, controversial, pornographic or xenophobic nature or that may offend the sensibilities of the general public. Finally, LA POSTE VENTURES reserves the right to remove a hypertext link to its Website at any time if it considers that it does not comply with its editorial policy.
ARTICLE 7 – PERSONAL DATA
For any information concerning the processing of your personal data by LA POSTE VENTURES, please refer to the tab on the Website entitled “Protection of Personal Data”.
ARTICLE 8 – CONFIDENTIALITY
LA POSTE VENTURES undertakes to preserve the confidentiality of the information communicated by a User, including all technical and financial information, information relating to know-how and commercial methods communicated via the contact form on the LA POSTE VENTURES website (hereinafter referred to as “the Information”), whether in the free fields of the said form or in an attached file.
LA POSTE VENTURES undertakes not to use, disclose or reveal the Information to any natural or legal person other than its employees, partners or subcontractors without the User’s prior consent.
This confidentiality obligation does not apply to Information of which LA POSTE VENTURES was already aware before receiving it and of which it has free disposal, to Information that has fallen into the public domain or that has previously been disseminated to the public, to Information that has been disseminated to the public without violating this clause, to Information that has been indicated as non-confidential by the User, to Information that has been requested by a public authority or a third party by a legal or regulatory obligation or by a court decision, as well as to Information that has been created by LA POSTE VENTURES.
This obligation of confidentiality shall remain in effect for a period of one (1) year as of the acceptance of these Terms and Conditions.
article 9 – LIABILITY
9.1 Responsibility of the User
All hardware and software required to access and use the Site remain the sole responsibility of the User, who is therefore solely responsible for the proper functioning of his equipment and his access to the Internet.
It is therefore up to the User to take all appropriate measures to protect his/her own data, computer systems and/or software from contamination by any viruses.
The User is solely responsible for the use he makes of the Site.
The User is responsible for all damage that he/she may cause to LA POSTE VENTURES as a result of non-compliance with the GCU.
In the event that the User fails to comply with these GTC, access to the Website may be blocked, without prejudice to any legal action that may be taken by LA POSTE VENTURES and any damages that may be claimed.
The User undertakes not to create a hypertext link without the agreement of LA POSTE VENTURES. The User undertakes to inform LA POSTE VENTURES without delay, by any means, of any error, fault or irregularity that he/she notices in the use of the Website, as soon as he/she becomes aware of it.
In order to respond to a security alert (anti-virus check, etc.), to a request from an authority (administrative, judicial or any other authorised authority), or to an alert from another User, LA POSTE VENTURES reserves the right, where applicable
- to retain, for evidence purposes, any information that does not comply with the rules set out in the General Terms of Use;
- to keep, for the purposes of proof, all logs, connection traces or data of a personal nature or otherwise proving the imputability of the User for the behaviour or actions in question;
- to modify, reject and/or delete access to any information that does not comply with the rules set out in these GCU;
- to apply the provisions of Article 10 “Termination – Default – Suspension” of the GCU.
9.2 Responsibility of LA POSTE VENTURES
LA POSTE VENTURES uses all reasonable means at its disposal to ensure quality access to the Website.
The Website is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of LA POSTE VENTURES and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Website.
Moreover, LA POSTE VENTURES may not be held liable for any malfunction of the network and/or servers or any other event beyond its control, which would prevent or impair access to the Website.
LA POSTE VENTURES reserves the right to interrupt, temporarily suspend or modify access to all or part of the Website without prior notice in order to carry out maintenance or for any other reason, without the interruption giving rise to any obligation or compensation.
LA POSTE VENTURES may not be held liable for any damage that may be caused by :
- the use of the Website by the User in a manner that does not comply with these GCU and with the regulations in force;
- the setting of the User’s computer to allow him/her to identify him/herself automatically and thus allow any third party to use the Website with his/her account or by usurping his/her identity. Consequently, to limit this risk, the User is invited to secure access to his account (deletion of cookies and automatic identification, etc.).
ARTICLE 10 – TERMINATION – DEFAULT – SUSPENSION
LA POSTE VENTURES reserves the right to temporarily interrupt access to the Website for reasons related to the security of the User or a breach by the User of one of his obligations, in particular those referred to herein.
LA POSTE VENTURES also reserves the right to unilaterally terminate the present contractual relationship in the event that the User proves to be in serious and/or repeated breach of any of its obligations, in particular those referred to herein.
This termination shall be carried out automatically, without prior notice and without prejudice to any damages that LA POSTE VENTURES may claim. The evidence mentioned in the Article Evidence Agreement of these GTCs may be kept as necessary by THE SALE POST.
ARTICLE 11 – RELATIONS WITH PARTNERS AND ADVERTISERS
Any commercial relations that you may have from the Website with the partners of LA POSTE VENTURES or the advertisers present on the Website are made directly with the latter without LA POSTE VENTURES being party to these relations. Consequently, LA POSTE VENTURES shall not be held liable for any prejudice that the User may suffer as a result of its relations with its partners and advertisers.
ARTICLE 12 – MISCELLANEOUS
If any of the clauses is held to be null and void, it shall be deemed to be unwritten but shall not entail the nullity of the other clauses. The failure of LA POSTE VENTURES to exercise any of the rights resulting from these GCU does not constitute a waiver of its rights.
ARTICLE 13 – APPLICABLE LAW – DISPUTES
The General Terms of Use are subject to French law. In the event of a dispute concerning the use of the Website, the User undertakes to contact LA POSTE VENTURES in order to attempt to resolve the dispute amicably.
The User and LA POSTE VENTURES remain free, if necessary, to refer the matter to the competent court.
